Third Draft of Energy Law Proposal Further Boosts Establishment of Energy Standard System

On November 4, the draft of the Energy Law was submitted for its third review during the Standing Committee meeting of the National People's Congress (NPC). To address the requirements of ensuring energy security and facilitating a green low - carbon transition, the third draft contains provisions which state that "the state shall establish and improve an energy standard system to ensure energy security, support green low - carbon transformation, and promote the development of new technologies, industries, and business models in the energy sector."

The second draft of this law was reviewed during the eleventh session of the 14th NPC Standing Committee in September this year. The second draft stipulated that "the state shall accelerate the construction of a new - type power system to enhance the grid's capacity to receive, allocate, and regulate clean energy." In response to this provision, some committee members suggested that since clean energy includes both renewable resources and nuclear power - with nuclear generation being relatively stable compared to wind or solar power - it would be more appropriate to change "clean energy" to "renewable energy". The current third draft has made corresponding modifications based on these suggestions.Moreover, the third draft provides more detailed regulations regarding the supply obligations of energy suppliers by adding a clause that they “must not illegally charge fees”. Furthermore, some committee members proposed clarifying responsibilities related to emergency management across provinces. In response, the third draft now includes provisions indicating: “The State Council's competent department for energy shall work with relevant departments under the State Council to strengthen guidance and coordination of cross - provincial energy emergency responses.”
